This is an aspect of the Kompetenz-Kompetenz principle (reflected in Article 16 of the Model Law) which recognises the ability of arbitral tribunals to rule on their own jurisdiction.

The doctrine of Kompetenz-Kompetenz has been adopted in the Arbitration Act 1996 and has revolutionised how jurisdictional issues are to be determined. Certainty in this area is elusive because there are different approaches to the doctrine by the national laws of different states.

The underlying object of this doctrine is to minimize judicial intervention in order to ensure that the arbitral process is not thwarted at the very threshold, merely because a preliminary objection is raised by one of the parties.
